Valued Customer/Cardholder:

To activate your membership with U.S. Family Advocates, Inc. there is a fee of $100.00. Then, starting seven (7) days after your enrollment, there is periodic monthly fee of $39.50. This $39.50 charge will continue every thirty (30) days until you wish to discontinue your membership. Nothing in these terms and conditions shall be construed to be a retail installment sales contract. Included in the $100.00 enrollment fee and the $39.50 monthly recurring charge is unlimited consultations with your case manager between the hours of 8:00 AM to 5:00 PM Pacific Time Monday through Friday. All such fees are non-refundable.

The general U.S. Family Advocates, Inc. TERMS & CONDITIONS are incorporated herein by reference. The purchase of any document preparation services is subject to those Terms & Conditions and the sale of such preparation services are governed thereby. The document preparation service provided by U.S. Family Advocates, Inc. brings to the legal market an affordable document assembly system intended to create various legal forms. As indicated elsewhere in this Terms and Conditions statement, the legal information and legal documents available through this web site are not a substitute for the legal advice of an attorney who is a member of the bar of the state where the purchaser lives.

Purchaser agrees and acknowledges that the document preparation service is a document assembly process only, for or into which purchaser provides information to U.S. Family Advocates, Inc. to be inserted into standard legal documents. Purchaser is purchasing from U.S. Family Advocates, Inc. a legal product in the form of a template of a legal document for which purchaser is requesting that U.S. Family Advocates, Inc. insert the information or data that purchaser provides - purchaser is not purchasing any legal service or legal advice.

U.S. Family Advocates, Inc. does not offer legal advice and is not a law firm or law practice. The information provided by U.S. Family Advocates, Inc. on its web site is similar to that provided by self-help law books and legal forms offered for sale through retail outlets. Purchaser understands that the purchaser's situation may be unique, and that the legal information contained on the U.S. Family Advocates, Inc. web site may not fit the purchaser's circumstances, in which case seeking the advice of an attorney would be advisable.

U.S. Family Advocates, Inc. requires payment in full of the price quoted by any of our associates before we will deliver the documents to you.

The service of the site and each form and document is provided with the understanding and agreement that U.S. Family Advocates, Inc. is not engaged in rendering legal, accounting or other professional services. If legal or other expert assistance is required, the services of a competent professional should be sought. Purchaser assumes all responsibilities and obligations with respect to all information provided and any decisions made concerning the documents for which U.S. Family Advocates, Inc. will provide document preparation services or resulting from the use of any form or document or document preparation services provided by U.S. Family Advocates, Inc. and for the selection of a form or document to achieve the purchaser’s intended results. Purchaser understands, that U.S. Family Advocates, Inc. is not acting as the purchaser’s attorney in any way and that no attorney-client privilege is created by this relationship.

Purchaser acknowledges and agrees that purchaser must, in order for U.S. Family Advocates, Inc. to complete Purchaser's legal documents, provide U.S. Family Advocates, Inc. with all relevant information necessary to accomplish that purpose, as the same is requested by U.S. Family Advocates, Inc. via its questionnaire or otherwise. Purchaser understands and acknowledges that U.S. Family Advocates, Inc. shall not be obligated to prepare any document so purchased when purchaser has failed, or is not able, to provide the necessary and required information to U.S. Family Advocates, Inc. to accomplish this task. Should purchaser fail or be unable to provide U.S. Family Advocates, Inc. with all relevant and necessary information to permit U.S. Family Advocates, Inc. to completely and accurately prepare the document so purchased by purchaser, U.S. Family Advocates, Inc. shall not be obligated to issue or provide purchaser with any refund or reimbursement. It is the sole and exclusive obligation of the purchaser to provide the appropriate and necessary information to U.S. Family Advocates, Inc. Additionally, such information must be provided in a timely manner and any completion dates given by U.S. Family Advocates, Inc. may be adjusted if purchaser fails to timely submit such information.

U.S. FAMILY ADVOCATES, INC. DOES NOT HAVE OR ASSUME ANY RESPONSIBILITY FOR THE CONTENT OF THE FORMS THAT ARE CREATED, EXCEPT TO THE EXTENT THAT THE INFORMATION THAT YOU PROVIDE IS ACCURATELY INSERTED INTO THE LEGAL FORM TEMPLATE. YOU ALONE ARE RESPONSIBLE FOR UNDERSTANDING THE RESULTS AND CONSEQUENCES OF THE INFORMATION AND DATA PROVIDED TO U.S. FAMILY ADVOCATES, INC. FOR INCLUSION INTO THE LEGAL FORMS. U.S. FAMILY ADVOCATES, INC. SHALL HAVE NO LIABILITY OR RESPONSIBILITY TO YOU FOR ANY LOSS OR DAMAGE RELATED TO THE FORMS AND DOCUMENTS IT PROVIDES.

IF A COURT OR ANY OTHER BODY HAVING THE POWER TO RULE ON DISPUTES DECIDES THAT ANY PART OF THIS DISCLAIMER IS NOT REASONABLE OR CANNOT BE ENFORCED FOR ANY REASON, THIS WILL NOT AFFECT THE VALIDITY OF THE OTHER PARTS OF THIS DISCLAIMER WHICH WILL CONTINUE TO BE IN FULL FORCE AND EFFECT.

GENERAL WARRANTY AND LIABILITY DISCLAIMER; LIMITATION OF LIABILITY - DOCUMENT PREPARATION:

(a) Warranty. U.S. FAMILY ADVOCATES, INC. MAKES NO IMPLIED WARRANTIES OF ANY KIND, AND HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR WARRANTY OF NON-INFRINGEMENT.

(b) Liability. In no event will U.S. Family Advocates, Inc. be liable for any indirect, incidental, special or consequential damages arising out of or in any way connected with the use of the document preparation services, whether based in contract, tort, strict liability or otherwise. The liability of U.S. FAMILY ADVOCATES, INC. for direct loss arising out of the use of the document preparation services, whether based in contract, tort, strict liability or otherwise is limited to the total amount paid, if any, by purchaser to U.S. Family Advocates, Inc. for document preparation services rendered.

PRIVACY POLICY - DOCUMENT PREPARATION SERVICES

Because the purchaser's privacy is important to us, U.S. Family Advocates, Inc. uses the personal data that purchaser provides only to complete the document preparation services that purchaser requests. However there is one exception to this rule. It is as follows.

“ Since we do not give legal advice or represent ourselves as attorneys , we are not bound by the attorney client privilege to any client or customer. Accordingly, If there arises any dispute regarding billing matters, disputes or related matters with respective to services provided by US Family Advocates Inc. to the client or customer, we specifically reserve the right to publish the factual history documented in our data base regarding what has transpired in the case in defense of slanderous and totally false claims made against our company. It is critical for the public and regulatory boards to have the opportunity to review our side of any given dispute. This provision is necessary even though we rarely receive any form of complaint, but when we do, we reserve the right to properly defend ourselves. This right is necessary because we cannot guarantee results in any given case, just as an attorney should not guarantee a result in a case. We are a document preparation service and specifically do not give legal advice. Additionally, we have been presented with incredibly false accusations in the past; therefore this provision is necessary to protect the integrity of our company.”

DISCLOSURE OF INFORMATION AND SECURITY - DOCUMENT PREPARATION SERVICES

U.S. Family Advocates, Inc. will not provide any personally identifying information to any third party without the purchaser's express consent provided, however, that purchaser is advised that in the event U.S. Family Advocates, Inc. determines in its reasonable discretion that disclosure of personal identifying information is necessary to comply with any law, rule order, subpoena, civil investigative request or demand, discovery request or any other legal requirement, U.S. Family Advocates, Inc. may disclose the purchaser's personally identifying information to comply with such request, and it may be disclosed without prior notice to purchaser. U.S. Family Advocates, Inc. agrees to take reasonable efforts to protect the purchaser's personally identifying information in the event of such disclosure, provided however, that purchaser agrees that U.S. Family Advocates, Inc. shall not be liable to purchaser for any claim by purchaser that U.S. Family Advocates, Inc. failed to exercise reasonable care in protecting the purchaser's personally identifying information. Purchaser also acknowledges that, despite efforts of U.S. Family Advocates, Inc. to maintain the purchaser's information secure, information exchanged via the internet can be compromised and third parties may attempt to connect to or intercept information from U.S. Family Advocates, Inc.' computer systems, and that despite U.S. Family Advocates, Inc.' efforts to prevent such occurrence, such third person's may be able to obtain copies of the purchaser's personally identifying information. Purchaser agrees that U.S. Family Advocates, Inc. is not responsible to purchaser for any inadvertent disclosure or unauthorized access by any third party of the purchaser's personally identifying information.

The document preparation services and associated fees for paid those services performed by US Family Advocates Inc. specifically does not include any applicable filing fees required for the case. Those fees will be in addition to our services and paid directly to the appropriate clerk of court.

RUSH ORDER CONDITIONS AND STIPULATIONS FOR DOCUMENT PREPARATION SEVICES

Your draft documents will be delivered to you by the e-mail address you provided in 7-10 business days as long as the following are completed.
1. You have completed the Questionnaire and Narrative on our website.
2. If you are doing a modification, we have a copy of the order that is currently in effect.
3. We have received payment in full for whatever you where quoted to do the rush order.
Your delivery date of 7-10 business days starts when all 3 of these conditions have been met.

REFUNDS POLICY - DOCUMENT PREPARATION SERVICES – MEMBERSHIP
MEMBERSHIP
U.S. Family Advocates, Inc. will refund any and all fees if it is determined by U.S. Family Advocates, Inc. that it cannot render the services it agreed to perform. U.S. Family Advocates, Inc. will not refund any fees if you decide you no longer wish to take advantage of the services offered.

DOCUMENT PREPARATION SERVICES
No purchase price refund will be issued to the purchaser for document preparation services once U.S. Family Advocates, Inc.' document preparation personnel begin any type, amount or form of work on the document preparation service so purchased. U.S. Family Advocates, Inc., in its sole discretion, shall determine when any type, amount or form of work on the document preparation service has begun or has been provided. Further, purchaser agrees and acknowledges that the purchaser shall be solely responsible for and shall bear (and/or reimburse) U.S. Family Advocates, Inc. for any charge back fees issued to U.S. Family Advocates, Inc. by or from any credit card company, merchant service or other source of payment that is initiated at the request of the purchaser. Stated another way, should purchaser request a refund or charge back from any credit card company, merchant service or other source of payment on the purchase of U.S. Family Advocates, Inc.’ document preparation service and should said card company, merchant or other source thereafter impose any fee or amount to U.S. Family Advocates, Inc. at the request of said Purchaser for or as a result, purchaser shall reimburse U.S. Family Advocates, Inc. for the refund amount plus the said charge back fee or amount. If, U.S. Family Advocates, Inc. decides that a refund is applicable, U.S. Family Advocates, Inc. shall hold 15% of the amount charged to client’s card for administrative expenses.

CANCELATION POLICY
If you decide you would like discontinue your membership for any reason, U.S. Family Advocates, Inc. will cancel your membership immediately only upon receipt of an email from you and the cardholder on file (if different person) clearly identifying Customer/Cardholder by: First Name, Last Name. E-mail directly to billing@usfamilyadvocates.com indicating that you wish to discontinue your membership. This policy is in effect to protect Customer/Cardholder and U.S. Family Advocates, Inc. against anyone but Customer/Cardholder from discontinuing the membership. U.S. Family Advocates, Inc., reserves the right to cancel any member at any time.
Furthermore, U.S. Family Advocates, Inc. reserves the right to automatically discontinue Customer/Cardholder membership if your automatic monthly billing fails more than twelve (12) consecutive times. If you desire to reactivate your membership thereafter, there is a $50.00 reactivation fee. Your monthly billing cycle would then begin again on the date of the reactivation and you would be billed every thirty (30) days thereafter.
